Although the PSI has a “Declaration of Prohibition Principles” and the G7 Global Partnership, several G7 leaders` declarations, neither has a legally binding document, which sets out specific commitments and is signed or ratified by member states. The separation between the two is often unclear and is often politicized by disagreement within a government over a treaty, as a non-self-executive treaty cannot be implemented without the correct modification of national law. Where a treaty requires implementing laws, a State cannot fulfil its obligations by not adopting the necessary national laws by its legislator. Article 56 of the Vienna Convention on the Law of Treaties provides that, where a contract does not say whether it can be terminated or not, there is a rebuttable presumption that it cannot be terminated unilaterally, unless before 1871 the United States government had regularly entered into contracts with Native Americans, but the Indian Appropriations Act of March 3. In 1871 (chap. 120, 16 Stat. 563) had joined a horseman (25 U.S.C. § 71) who effectively ended the elaboration of the presidential treaty by providing that no Indian nation or Indian stock is recognized as an independent nation, tribe or power with which the United States may enter into contracts. . . .
